Facing criminal proceedings for the first time brings unfamiliar terminology and the feeling that the system knows the rules while you do not. These are the rights that matter in practice and how to exercise them.
The right to silence
Suspects and defendants may decline to give a statement. Exercising that right must not be used against them. Silence is not an admission. It is a legitimate defence option where a premature statement would do more harm than good.
The right to a lawyer
You may be assisted by a lawyer of your choice throughout the proceedings. In specified cases, legal assistance is mandatory. Seek advice before making a statement, signing a procedural document or voluntarily providing material, while complying with lawful measures imposed by the authorities.
The right to information
You have the right to know the alleged act and its legal classification. Meaningful defence depends on that information. Access to the case file, subject to the lawful restrictions applicable during the investigation, allows counsel to understand the prosecution’s evidence.
The right to propose evidence
The defence can actively build its case by requesting documents, witness testimony and expert evidence. A refusal to obtain evidence must be reasoned, and unjustified refusals can be challenged through the applicable procedural mechanisms.
Rights during questioning
Your statement is recorded and should be read before signing. You can request corrections and additions there and then. Leading questions and pressure are not permitted. If the direction of the questioning affects your position, consult your lawyer.
Knowing a right in theory is different from exercising it correctly under pressure. Helping you make those decisions at the right moment is part of defence counsel’s role.
